Remember the Federalist Society convention in D.C. last November, when someone got up and shouted "Tyrant!" at then-Attorney General Michael Mukasey -- just minutes before Mukasey passed out and collapsed? Well, the shouter was Washington Supreme Court Justice Richard Sanders, and today Justice Sanders elaborated, you might say, with a column in the Seattle Times.
Sanders urged the new attorney general, Eric Holder Jr., not just to give the Bush administration a pass for its improprieties in the handling of enemy combatants and wiretapping of Americans in the name of national security.
"Some take the position that we should forgive and forget or 'look forward,' as President Obama has ambiguously suggested," Sanders wrote. "But 'looking forward' without prosecution of past cries brings the unsettling question of why prosecute future crimes of the same nature? After all, all criminal prosecutions are prosecutions for past acts, not future ones. And, make no mistake, these are real crimes." Sanders continued, "I do not question the motives or patriotism of those responsible for these policies. But this does nothing to mitigate the fact that these steps were wrong when they were initiated and they are wrong today. We owe the American people a reckoning."
We need more hecklers like Justice Sanders.
