Judge Emmett Sullivan says he won't declare a mistrial in the case against Sen. Ted Stevens in the wake of revelations this morning that FBI records had been withheld from Stevens' defense team.
Sullivan, however, found that the government violated rules of evidence by withholding records from Stevens' lawyers. The government's lead prosecutor, Brenda Morris, said in court that the Justice Department's Office of Professional Responsibility would be opening an investigation.
